محرومیت از آزادی مطابق ماده 7 اساسنامه دیوان کیفری بین المللی در چارچوب سیستماتیک یا گسترده جنایت علیه بشریت

چکیده

یکی از آزادیهای اساسی و حقوق بنیادین نوع بشر برخورداری از حق آزادی جسمانی می‌باشد. گونه‌ای که اسناد بین المللی حقوق بشر به رسمیت شناختن و تأکید بر احترام و عدم تعرض به آن پافشاری نموده‌اند. مقاله حاضرکاربردی و روش آن کتابخانه‌ای و هدف آن بررسی عناصر تشکیل دهنده حبس یاسایر محرومیت‌های شدید از آزادی جسمانی در ماده 7 اساسنامه دیوان بین المللی کیفری می‌باشد. سؤال اصلی این مقاله  این است که، محرومیت سازمان یافته و گسترده شهروندان از آزادی در چارچوب ماده ۷ اساسنامه دیوان کیفری بین المللی چه مصادیقی را در بر می‌گیرد؟ در نتیجه این اسناد علاوه بر به رسمیت شناختن و تاکید بر حق آزادی جسمانی افراد و منع بازداشت خود سرانه در جهت تضمین هر چه بیشتر این حق و آزادی اساسی به تعیین تضمیناتی همچون حق برآگاهی از دلایل بازداشت حق بر حضور فوری در برابر یک مقام قضایی پرداخته‌اند. در واقع حقوق فردی در زمینه صیانت از نفس پیامد تکوین حقوق مالکیت نیز هست به گونه ای که تکامل حقوق مالکیت به معنای موسع آن در برگیرنده حق افراد بر مالکیت بر ابعاد ذهنی، مادی، روانی و جسمی و فکری خود نیز هست.

چکیده [English]

abstract
One of the basic freedoms and fundamental rights of mankind is the right to physical freedom. The way that international human rights documents have insisted on recognizing and emphasizing respect and non-aggression. The present article is applied and its method is a library and its purpose is to examine the constituent elements of imprisonment or other severe deprivations of physical freedom in Article 7 of the Statute of the International Criminal Court. The main research question is the organized and extensive deprivation of freedom of citizens within the framework of Article 7 of the Statute. What examples does the International Criminal Court include?
As a result of these documents, in addition to recognizing and emphasizing the right to physical freedom of individuals and the prohibition of arbitrary arrest, in order to guarantee as much as possible this right and basic freedom, to determine guarantees such as the right to be informed of the reasons for the arrest, the right to be immediately present before a judicial authority. and have
